LAW REVISION COMMISSION COMMENTS
Section 708.530 incorporates the rule generally applicable to assignments of general intangibles and other rights to payment. Under Civil Code Section 955.1 and this section, the judgment creditor who has obtained an assignment under this article will have priority over another assignee of the same right for value and without notice only if the judgment creditor first gives notice to the obligor. See also Section 708.540. [16 Cal.L.Rev.Comm. Reports 1527 (1982)].
Section 708.530 is amended to provide a special rule governing assignments of rights to future rent. Subdivision (b) recognizes such assignments as instruments affecting real property subject to the recording act. [17 Cal.L.Rev.Comm. Reports 1020 (1983) ].
